Welcome to the Gro App. By downloading or using the Gro App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the Gro App.

App Description and Use

• Gro App provides information about different plants and allows users to set up reminders about their indoor plant's needs. The information provided is for general informational purposes only and does not constitute professional advice. The user agrees to use the information provided in the Gro App at their own risk.

User Account and Information

• To use the Gro App, the user must create an account by providing their email address or logging in with their Apple, Google or Facebook credentials. The user is responsible for maintaining the confidentiality of their account information, including their password. The user agrees to provide accurate and complete information when creating an account and to update their account information as necessary.

The Gro App allows users to upload photos of their plants. The user acknowledges that any photos they upload will be stored by the Gro App, and they are solely responsible for the content of the photos they upload.

The Gro App uses Appsflyer to identify traffic sources and Amplitude to track user behavior in the app. The user agrees to the collection and use of their data by the Gro App and its service providers as described in the Privacy Policy.

Payment

• The Application is free for all Users to use. However, if you decide to access our enhanced, paid content, the following payment and billing terms will apply.

We offer premium features of the Application through a monthly or annual subscription. Upon purchase confirmation, your iTunes account will be charged. The subscription will automatically renew unless you disable auto-renewal at least 24 hours before the billing period ends. You can manage your subscription and turn off auto-renew in your iTunes Account Settings. To restore previous purchases, use the "Restore Purchases" button in the Premium Features popup.

The Premium features provide you access to certain enhanced products, services, features and functionality (e.g.,removing restriction on number of plants and notifications). By using the Premium features, you agree to pay any applicable fees or charges associated with them, including access fees.

You authorize the App Store to charge the relevant fees to your payment card. By signing up for specific subscriptions, you acknowledge that they may be automatically renewed. If you don't cancel your subscription, the App Store will charge you for the renewal term. The auto-renewal period will be the same as your initial subscription period, unless otherwise stated in the Application. The renewal rate will not exceed the rate for the previous subscription period, excluding any promotional or discount pricing, unless we notify you of a rate change before auto-renewal. You must follow the cancellation procedures specified for the particular subscription. Unfortunately, we do not refund accrued fees or prorate fees for canceled subscriptions.

The Provider might offer a free trial subscription for the Premium features, with details specified during sign-up. If you don't cancel before the trial ends, your access to the Application will automatically continue, and you will be charged for the Premium features. While the Provider may send reminders, it remains your responsibility to track the trial period. The Provider reserves the right to modify or terminate free trial offers, access to Premium features during the trial, or any of these terms without prior notice and without liability.

The Premium features and your rights to use them expire at the end of the paid subscription period. Failure to pay the fees or charges may result in the Provider notifying you to resolve the issue; however, the Provider reserves the right to disable or terminate your access to the Premium features without notice.

All purchases of the Premium features are final and non-refundable, regardless of whether you actively use them or not.

Subscriptions purchased through an App Store are subject to that store's refund policies. As a result, Provider cannot issue refunds, and you will need to contact the App Store's support for assistance.

To the extent permitted by applicable laws, we reserve the right to change the payment terms and set prices for services offered through the Application at any time. We will give you reasonable notice of any such changes by posting the updated prices on or through the Application.

If you do not wish to pay for access to the Application, you can stop using it before any changes to the payment terms take effect.

Intellectual Property

• The Gro App and its content, including but not limited to text, graphics, images, logos, and software, are the property of Gro or its licensors and are protected by copyright, trademark, and other intellectual property laws. The user agrees not to use or reproduce any part of the Gro App or its content without the prior written consent of Gro.

Limitations of Liability

• The user agrees that Gro is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Gro App or its content, even if Gro has been advised of the possibility of such damages. The user acknowledges that the Gro App may not be available at all times, and Gro is not responsible for any interruptions, errors, or delays in the Gro App.

Dispute Resolution

• Any dispute arising out of or relating to these Terms or the Gro App shall be resolved in accordance with the laws of the jurisdiction where the user resides.

Changes to these Terms

• Gro reserves the right to update or modify these Terms at any time. The user agrees to be bound by any such changes or modifications.

Termination

• Gro may terminate or suspend the user's access to the Gro App at any time, without notice, for any reason.

Miscellaneous

• These Terms constitute the entire agreement between the user and Gro regarding the use of the Gro App. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
